Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Our intention here is to present the essential character of classical, sunnī kalām within a strictly formal perspective and to set out its basic aspects. It was conceived by the mutakallimīn as a rational, conceptual, and critical science and, although kalām differed in a number of basic concepts and constructs and in its analytic system, the topical organisation of the major compendia parallels that of metaphysics as understood in the contemporary Aristotelian tradition. The debates between kalām and falsafa need to (...) be examined within this context. Kalām, however, is theological in the strict sense of the term and it is as such that its problematic and its procedures are primarily to be understood. Thus seen, the object of kalām is to rationalise the cognitive content presented to Believers in the symbolic language of the koranic revelation. It has, then, four principal tasks, sc, to conceptualise, to order, to explain, and where possible to justify the primary doctrines of the community whose belief is held to be normative. Within this framework the differences that characterise the major schools as such and the various tendencies of individual masters within each school may readily be brought to light. Most experts would agree that the current medical malpractice system in the United States does not work effectively either to compensate victims fairly or prevent injuries caused by medical errors. Policy responses to a series of medical malpractice crises have not resulted in effective reform and have not altered the fundamental incentives of the stakeholders. In Medical Malpractice, economist Frank Sloan and lawyer Lindsey Chepke examine the U.S. medical malpractice process from legal, medical, economic, and insurance perspectives, analyze past (...) efforts at reform, and offer realistic, achievable policy recommendations. They review the considerable empirical evidence in a balanced fashion and assess objectively what works in the current system and what does not. Sloan and Chepke argue that the complexity of medical malpractice stems largely from the interaction of the four discrete markets that determine outcomes--legal, medical malpractice insurance, medical care, and government activity. Argumentation as the public exchange of reasons is widely thought to enhance deliberative interactions that generate and justify reasonable public policies. Adopting an argumentation-theoretic perspective, we survey the norms that should govern public argumentation and address some of the complexities that scholarly treatments have identified. Our focus is on norms associated with the ideals of correctness and participation as sources of a politically legitimate deliberative outcome. In principle, both ideals are mutually coherent. If the information needed for a correct deliberative (...) outcome is distributed among agents, then maximising participation increases information diversity. But both ideals can also be in tension. If participants lack competence or are prone to biases, a correct deliberative outcome requires limiting participation. The central question for public argumentation, therefore, is how to strike a balance between both ideals. Rather than advocating a preferred normative framework, our main purpose is to illustrate the complexity of this theme. (shrink)

This article has two purposes. The first speaks to the compatibilist quality of Charles Mills’ Black Radical Kantianism (BRK), its strengths and weaknesses and the pertinence of W. E. B Du Bois to it. BRK turns from Mills’ previous critique of Kantianism as representative of arassenstaatlichpolitical liberalism, underwritten and tainted by the racial/domination contract, to his current defence of a compatibilist Kantianism as representative of arechtsstaatlichpolitical liberalism supported by a non-ideal racially corrective critique of both that contract and the kind (...) of political liberalism affiliated with it. The second focuses on what I introduce as the ‘Radicalization of Kant in Black’ (RKB). RKB isnota compatibilist project. Rather it re-examines issues first posed by ‘slave- and black-encoded’ blacks coming to act and struggle with the primacy of practical reason under the historically normative authority of freedom and the abolition of enslavement. One of the most distinguished cultural and intellectual historians of our time, Frank Turner taught a landmark Yale University lecture course on European intellectual history that drew scores of students over many years. His lectures—lucid, accessible, beautifully written, and delivered with a notable lack of jargon—distilled modern European history from the Enlightenment to the dawn of the twentieth century and conveyed the turbulence of a rapidly changing era in European history through its ideas and leading figures. Richard A. Lofthouse, (...) one of Turner’s former students, has now edited the lectures into a single volume that outlines the thoughts of a great historian on the forging of modern European ideas. In his first summer lecture at Berkeley in 1914, Josiah Royce, American philosopher of community, confessed as follows.

Life goals or aspirations can be distinguished as intrinsic or extrinsic, with different implications for well-being. In this study we used network analysis to reexamine this intrinsic-extrinsic distinction, illustrating how novel candidate aspirations can be mapped along this dimension using innovative methods. We identify four previously unexamined life aspirations, predicting that aspiring for power and social adherence would group with extrinsic goals, whereas aspiring for self-expression and mastery would group with intrinsic goals. In two samples (n = 196; n = (...) 346) we analyze both the original life-goal variables and these novel aspirations using factor analysis, multidimensional scaling, circumplex modeling, and a network analysis using a graphical least absolute shrinkage and selection operator (glasso) to estimate the network structure of aspirations using EBIC. Replicating past intrinsic-extrinsic distinctions, all four methods further classified power and social adherence as extrinsic goals, and self-expression and mastery as intrinsic goals. The intrinsic-extrinsic distinction was also clearly visible in the network analysis. Finally, consistent with hypotheses, power and social adherence were unrelated to wellness indicators, whereas self-expression and mastery correlated positively with well-being indicators and negatively with ill-being indicators, supporting their hypothesized nature as extrinsic and intrinsic, respectively. Environmental health research produces scientific knowledge about environmental hazards crucial for public health and environmental justice movements that seek to prevent or reduce exposure to these hazards. The environment in environmental health research is conceptualized as the range of possible social, biological, chemical, and/or physical hazards or risks to human health, some of which merit study due to factors such as their probability and severity, the feasibility of their remediation, and injustice in their distribution. This paper explores the ethics of (...) identifying the relevant environment for environmental health research, as judgments involved in defining an environmental hazard or risk, judgments of that hazard or risk's probability, severity, and/ or injustice, as well as the feasibility of its remediation, all ought to appeal to non-epistemic as well as epistemic values. I illustrate by discussing the case of environmental lead, a housing-related hazard that remains unjustly distributed by race and class and is particularly dangerous to children. Examining a controversy in environmental health research ethics where researchers tested multiple levels of lead abatement in lead-contaminated households, I argue that the broader perspective on the ethics of environmental health research provided in the first part of this paper may have helped prevent this controversy. This paper discusses ethical issues surrounding Integrated Assessment Models (IAMs) of the economic effects of climate change, and how climate economists acting as policy advisors ought to represent the uncertain possibility of catastrophe. Some climate economists, especially Martin Weitzman, have argued for a precautionary approach where avoiding catastrophe should structure climate economists’ welfare analysis. This paper details ethical arguments that justify this approach, showing how Weitzman’s “fat tail” probabilities of climate catastrophe pose ethical problems for widely used IAMs. The main (...) claim is that economists who ignore or downplay catastrophic risks in their representations of uncertainty likely fall afoul of ethical constraints on scientists acting as policy advisors. Such scientists have duties to honestly articulate uncertainties and manage (some) inductive risks, or the risks of being wrong in different ways. (shrink)

: This article aims: 1) to review several, key, earlier studies of Josiah Royce's relations to Asian thinkers (mainly Indian); 2) to discover through a survey of Royce's writings how widely and deeply Royce familiarized himself with, and employed Hindu, Buddhist, and other Asian traditions; and, 3) to measure how relevant Royce's most mature philosophy (1912–1916) is for the currently needed inter-cultural, inter-religious, and inter-faith dialogues. Parts One and Two supply foundations which reveal Royce's lifelong commitment to open "windows" to (...) Eastern thought, in order to dialogue with Asian thinkers and invite other Westerners to do the same. The article climaxes in Part Three by revealing the relevance of the late Royce's "philosophy of the 'Spirit,' his "philosophical pneumatology." I trace ten of its implied positions, significant for contemporary philosophers of religion and theologians. I conclude by showing that Royce's "philosophy of the 'Spirit"' and its implied positions are all rooted in Royce's view of a "middle faith." Such a faith supports his view of the "invisible church," his "Beloved Community of all "Christians"—"Christians" taken in his wider sense of "all genuine loyalists who are members of a Beloved Community.". The reasons supporting the ‘Racial Contract’ are reasons supporting the ‘metanarrative,’ which explains the Racial Contract. They are not reasons supportive of actions pertinent to undoing the Racial Contract, but reasons supportive of behavior pertinent to objectively confirming the ‘metanarrative’ of the ‘Racial Contract’ and rightfully establishing its place in political philosophy. This paper shall attempt to address these matters and their consequences.

Blue Jean Buddha is highly readable and mind-opening to those unfamiliar with the growth of Buddhist communities and practitioner networks in North America as well as for text and church-bound academicians of Buddhist-Christian discourse.Blue Jean Buddha:Voices of Young Buddhists is a medley of twenty-nine upbeat and down-home personal testimonies of mostly Westerners who were raised as Buddhists in the United States or who converted early on in life. The book is divided into four parts: Lessons, Life Stories, Livelihood, and Reflections. Refreshingly immediate introductory pages (really a series of questions!) and the concluding Reflections are offered by editor Sumi Loundon, an artist and graduate of Harvard Divinity School and former chair of the Harvard Buddhist Community. Sumi herself was born into a small Zen community in rural New Hampshire, practiced vipassana for years and is now committed to the Buddhist traditions of Korea, where I first met her at a temple in Seoul. She is planning to come out with a second volume of essays by more representatives of America's fertile Buddhist garden in 2004.The essays in Blue Jean Buddha are a cornucopia of commentary and questions about the reception of Buddhism in the West, the spiritual odysseys of exceptional young seekers, and thoughtful ruminations on the transformative effects of dharma practice for personal and social change.
